By creating an account or using the GetInked mobile app or web platform (collectively, the “Service”), you agree to these Terms of Service (“Terms”) with JavlinAI, Inc. (“GetInked,” “we,” or “us”). If you do not agree, do not use the Service.
You must be at least 18 years old to use GetInked. By using the Service, you represent that you are at least 18 and have the legal capacity to enter into this agreement.
GetInked is a business management platform for tattoo artists. It provides tools for booking management, portfolio display, client records, consent form collection, deposit payment processing, and automated client communications (SMS reminders and aftercare texts).
GetInked is a B2B service. Artists use GetInked to manage their business. Clients who book appointments interact with artist-controlled public profile pages; their data is managed by the artist as the data controller.
GetInked offers paid subscription plans. Beta participants may receive a lifetime discounted rate as described in their beta agreement. Billing occurs monthly or annually depending on your selected plan.
When artists enable deposit collection, client payments are processed by Stripe directly to the artist's connected Stripe account. GetInked is not the merchant of record for these transactions. Refund policies for client deposits are set by the individual artist. GetInked may collect a platform fee on transactions as described in the relevant plan details.
Subscription fees are non-refundable unless required by law. If you cancel, your access continues until the end of the current billing period.
You retain ownership of content you upload (portfolio images, consent form templates, client notes). By uploading content, you grant GetInked a limited license to store, display, and transmit your content solely to provide the Service.
You are responsible for ensuring you have the right to upload any content, and that your content does not violate any third-party rights or applicable laws. GetInked does not review content but may remove content that violates these Terms.
You agree not to:
GetInked sends SMS reminders and aftercare texts to clients on behalf of artists, using client phone numbers that artists have collected and stored with client consent. Artists are responsible for obtaining proper consent from their clients before adding client phone numbers to GetInked. Artists must comply with applicable SMS marketing laws including TCPA (US) and CASL (Canada).
You may delete your account at any time by contacting support@getinked.co.
We may suspend or terminate your account if you violate these Terms, if we discontinue the Service, or for any reason with reasonable notice. Upon termination, your access ends immediately and we will delete your data per our Privacy Policy.
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
GetInked is not a substitute for legal, medical, or professional advice. Consent forms provided through GetInked are templates; artists are responsible for ensuring their consent processes meet applicable legal requirements in their jurisdiction.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETINKED'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO GETINKED IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) $100 USD. GETINKED IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES.
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law principles. Disputes shall be resolved in the state or federal courts located in New York County, NY, and you consent to personal jurisdiction in those courts.
We may update these Terms. We will notify you of material changes by email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
